Please carefully read the following license agreement, including terms and conditions. Once you have agreed to these terms and conditions and have paid the license fee, you will be able to download AICR’s 10 Cancer Prevention Recommendations Toolkit.
Section I: License Agreement
The American Institute for Cancer Research ("AICR") hereby grants to you ("Licensee") a non-transferable, non-exclusive license to use the Toolkit, solely in accordance with the terms and conditions of this Agreement. Licensee hereby agrees to use the Toolkit subject to the following terms and conditions and understands that AICR has the right to terminate this Agreement if Licensee violates any of its provisions. The scope of use permitted under this license is contingent upon payment of the license fee.
AICR reserves the right to take all legal action to prevent any unauthorized use. The license granted under this Agreement authorizes only the purchaser to use the Toolkit. If the purchaser is an individual that purchaser shall use the Toolkit for his or her own purposes. If the purchaser is an individual purchasing the Toolkit on behalf of an organization or company, the Toolkit shall only be used within that organization or company for its own purposes. This Agreement and AICR’s Toolkit may not be transferred, assigned, or sublicensed by Licensee. Information from the Toolkit shall not be used for any sale, resale, distribution, or any other commercial use. The contents of the Toolkit shall not be altered or changed. Licensee shall make best efforts to protect the Toolkit against unauthorized use or reproduction.
Section II: Limitation of Liability
AICR shall have no liability to Licensee or any other individual or entity connected with the Licensee for any claim, loss, or damage of any kind or nature arising out of use of the Toolkit.
Section III: No Warranty
The Toolkit is provided “as is” and Licensee accepts the entire risk as to the quality, performance and results of use of the Toolkit. AICR makes no warranties or representations, express or implied, oral or in writing, with respect to the Toolkit.
Section IV: Indemnification
Licensee shall be solely responsible for the operation and permitted use of the Toolkit. Licensee specifically undertakes to indemnify and hold AICR harmless from any loss or damage (or claim thereof) resulting from use of the Toolkit.
Section V: Jurisdiction
Licensee hereby agrees that the laws of the District of Columbia will apply to interpretation of this Agreement and further accepts the exclusive jurisdiction of the federal or local courts in the District of Columbia with respect to any claims brought in connection with violation of this Agreement or any use or misuse of the Toolkit.
